1 – Object

The purpose of the present regulation is to define the conditions and civil responsibilities of the client, who enters into a temporary contract with the taxpayer Pine Mountain Experience, Lda, number 517457172, with registered office at Avenida Coelho da Gama, 5 – 3200-200 Lousã and RNATT registration number 512/2023, for the use of bicycles. 

2 – General provisions

The bicycles to be rented to customers are the exclusive property of PINE MOUNTAIN EXPERIENCE, LDA and are intended for leisure rides within a 50km radius of its headquarters.

3 – Terms and conditions

Terms: 

a) The customer agrees to assume responsibility for possible damage to or loss of the bicycle(s) and accessories during the rental period;

b) The customer has the responsibility and obligation to respect traffic regulations;

c) In rentals that include night periods, it is the customer’s responsibility to park the bicycle in a safe place, indoors.

​Conditions:

a) PINE MOUNTAIN EXPERIENCE, LDA requires a security deposit or cash deposit of €100 per bike rented.

b) An identification document must be provided at the time of booking, and this must be made by individuals over the age of 18. Customers under the age of 18 must be authorized by their parents or legal guardians to participate in PINE MOUNTAIN EXPERIENCE, LDA. tours/rentals;

c) PINE MOUNTAIN EXPERIENCE, LDA will provide helmets and knee pads whenever requested, at no additional cost. – The use of helmets is compulsory for all bicycle users;

d) Booking – Bookings can be made by telephone, e-mail or via the company’s website. A deposit of 30% of the total amount will be required at the time of booking in order to guarantee your reservation. When making a deposit/payment by bank transfer, you must indicate the e-mail address or name you used when making the reservation, so that the source of the money can be easily identified. By making the monetary deposit, the client agrees to accept all these conditions, just as PINE MOUNTAIN EXPERIENCE, LDA, by accepting the client’s reservation, agrees to comply with its obligations;

e) Booking cancellation – In the event of cancellation of a bike rental by the customer, 7 days’ notice is required, free of charge. If this period is less than 7 days, 30% of the amount will be charged. In the event of cancellation by PINE MOUNTAIN EXPERIENCE, LDA, due to adverse weather conditions, forestry operations and other seasonal changes, the customer will receive a full refund of the deposit corresponding to their booking;

f) Customers voluntarily participate in activities developed by PINE MOUNTAIN EXPERIENCE, LDA, with knowledge of the numerous risks and dangers involved. Customers acknowledge and agree that PINE MOUNTAIN EXPERIENCE, LDA maintains no control over the operation of the bicycles rented by customers. PINE MOUNTAIN EXPERIENCE, LDA assumes no responsibility and cannot be held liable for:

● any personal injury, property damage, third party liability or other losses, accidents, delays, inconveniences or irregularities which may be occasioned by reason of any wrongful, negligent or accidental acts or omissions on the part of the customer or the customer’s agents;

● any defect or failure of any vehicle, equipment or instrument owned, operated or otherwise used by the customer;

● any unlawful or negligent acts or omissions on the part of any third party not under the direct or indirect control of PINE MOUNTAIN EXPERIENCE, LDA.

Clients exempt PINE MOUNTAIN EXPERIENCE, LDA, its owners, employees, affiliated entities, representatives, associates and volunteers from any and all liability arising during the rental period or demands/claims that may arise in the future in connection with participation in the activities organized for the client by PINE MOUNTAIN EXPERIENCE, LDA. Customers acknowledge that they are aware of the risks involved in cycling, including, but not limited to, physical exertion, forces of nature, accidents, travel by any means of transportation, adequacy of medical facilities or negligence (other than intentional or fraudulent) on the part of employees, agents or other members of PINE MOUNTAIN EXPERIENCE, LDA.

Clients agree to be responsible for their own well-being and accept any and all risks associated with the activities they undertake. Customers agree that the terms contained herein are binding on them, their family members, heirs, successors, assigns, dependents and/or minors accompanying them, and their legal representatives.

Clients acknowledge and agree that PINE MOUNTAIN EXPERIENCE, LDA, and its agents have the right to refuse participation to any person deemed incapable of activities, and not to sign this document or other required documentation. Any dispute arising from these matters shall be settled in binding arbitration/trial under the laws of the country of Portugal. Any part of this document deemed void or unenforceable shall not negate the execution of the remainder.

g) General data protection regulation – PINE MOUNTAIN EXPERIENCE, LDA, only stores the data provided by the customer and/or the contact form and subsequent communication, whether by telephone, WhatsApp, email or social networks relevant to their booking. Customer data is not shared with third parties, guaranteeing that it will not be used for purposes other than those directly relevant to your booking. h) Photos/Videos and their use – PINE MOUNTAIN EXPERIENCE, LDA guarantees that no photo or video in which you appear will be sold, nor will this content be made available to social media through our accounts. By booking our services, the client accepts that the photos/videos will be used by PINE MOUNTAIN EXPERIENCE, LDA for the company’s advertising purposes.

4 – Rental prices 

The rental prices are those set out in the price list provided by PINE MOUNTAIN EXPERIENCE, LDA.

The prices indicated include VAT at the rate in force. 

5 – Insurance and accidents

The rental of the bicycle implies civil liability insurance and personal accident insurance from PINE MOUNTAIN EXPERIENCE, LDA.

Civil liability insurance:

Personal accident insurance:

Death or permanent disability due to accident: €24.507,00

Treatment and repatriation expenses due to accident: €4.293,00

Medical assistance in Portugal: Contracted

For all of the above, the age limit is 75.

The accident must be reported to Fidelidade Seguros in writing within a maximum of 8 days.

The client must be insured, either by PINE MOUNTAIN EXPERIENCE, LDA or by himself, provided he can prove it.

The client is responsible for having travel insurance to cover medical care in the event of an accident outside the activities related to the tours/rental booked with PINE MOUNTAIN EXPERIENCE, LDA.

There is no insurance cover provided by PINE MOUNTAIN EXPERIENCE, LDA for our customers in the event of damage, theft or loss of rented bicycles or personal protective equipment.

6 – Damages

In the event of any type of damage to the rented equipment, by any fault of the client, the customer must immediately inform PINE MOUNTAIN EXPERIENCE, LDA and return the bike to the company, and PINE MOUNTAIN EXPERIENCE, LDA will charge the amount corresponding to the damage caused.

In the event of any type of damage to the rented equipment, for which the customer is not responsible, the customer must immediately inform PINE MOUNTAIN EXPERIENCE, LDA and hand the bicycle over to the company, which will replace it with a similar one, whenever available.

7 – Theft, loss and damage

The rental price does not include insurance against theft or total or partial loss of the bike (or other damage). It also does not include damage to personal equipment/objects carried in the vehicle due to any circumstance, be it vandalism or a traffic accident. 

For other risks, such as theft or loss of bicycles, there is a liability amount to be paid by the customer, corresponding to the value of the equipment.

Loss or damage of accessories are not covered by the liability amount and will be charged according to the general price list.

8 – Damaged parts

In the event of partial damage or loss of accessories, the customer is liable to pay PINE MOUNTAIN EXPERIENCE, LDA the amount corresponding to the repair and replacement of the damaged parts, according to the price list in force on the date of the event.

9 – Diverse

PINE MOUNTAIN EXPERIENCE, LDA reserves the right to update and/or change these terms and conditions at any time. The customer is responsible for being familiar with these terms and conditions.

In the event of any omissions in these regulations, the parties shall be governed by the law in effect.
